Privacy Policy Section for Your Valuation Form

A starting point for the section your own privacy policy needs once you publish a valuation form.

The leads from your valuation form land with you, which makes your agency the controller for that data. So the Imprint and Privacy Policy links under Account → Profile data have to point at your own pages, and your privacy policy has to describe what the form does.

Most agencies already have a privacy policy written for their website. It usually says nothing about an online valuation, because there wasn't one when it was written. You don't need a separate page — a section added to the existing one is enough, and the same page can serve as both Imprint and Privacy Policy if that's how yours is set up.

This is a starting point, not legal advice. It describes what the tool does with data so you don't have to work that out yourself. Whether it is complete and correctly worded for your business is for you or your lawyer to decide.

Draft wording

Replace everything in brackets. The retention period in particular is a decision, not a blank to fill in with the first number that looks reasonable.

Online property valuation

On our website we offer a free online property valuation. If you use it, we process the following data:

  • Property details: address, property type, living and land area, number of rooms, year of construction, condition and any further details you enter in the form.
  • Contact details: first name, last name, email address and telephone number.

Purpose. We use this data to produce a non-binding estimate of your property's value and to contact you about the result and a possible sale.

Legal basis. Your consent under Art. 6(1)(a) GDPR, given by ticking the box on the form. You may withdraw it at any time with effect for the future, by email to [YOUR EMAIL] or by telephone. Withdrawing it does not affect the lawfulness of processing carried out beforehand.

Recipients. The valuation form and the follow-up emails are operated on our behalf by our platform provider, fluss.ai, as our processor under a data processing agreement. To calculate the estimate, the address and property details are transmitted to an external valuation service. Your data is not sold or passed on for any other purpose.

Retention. We keep your enquiry for [RETENTION PERIOD], unless a longer statutory retention period applies or you ask us to erase it sooner.

Your rights. You have the right of access, rectification, erasure, restriction of processing, objection and data portability. You may also lodge a complaint with a supervisory authority. To exercise these rights, contact [YOUR NAME AND CONTACT DETAILS].

After you have written it

  1. Publish the page on your own website.
  2. Paste its URL into Account → Profile data, under Privacy URL (and Imprint URL, if the same page covers both).
  3. Open the contact step of your flow and check the consent text — the link in it should point at your policy, not ours.
